Terms
Paddenstoel puts small websites online. Here is what you can expect from us and what we expect from you. Paddenstoel is free and a trial version: we do our best, but we cannot promise everything.
In brief, for children too
You can put your own game or website here. Ask your parent or guardian first. Do not put anything on it that is mean, dangerous or belongs to someone else, and do not say who you are or where you live. If a site breaks the rules, we may remove it.
Who we are
Paddenstoel is an initiative by Jeroen Dee and Jeroen Gordijn. We are not a company yet; we will set one up soon. You can find how to reach us under Contact.
When these terms apply
They apply as soon as you click the confirmation link in our email and put your site online. If you let an AI assistant, the CLI or the API create a site for you, the same applies: you confirm it, so you agree. You are also responsible for what an assistant or script does on your behalf.
You can save or print this page. These terms are available in Dutch and English.
Who can use Paddenstoel
Everyone can use Paddenstoel, including children: especially to show their own game or website. Are you under 16? Ask your parent or guardian for permission first. You can also create the site using your parent's or guardian's email address; they will then be the owner. Everyone can see your site, and emails about your site go to the email address you provide. If you are a child, do not put your surname, address, school or photos of yourself or others on your site.
Your site and your email address
- The owner of a site is the person who controls the email address used to confirm the site. You use that address to put a new version online, and we send emails about your site to it. So keep your mailbox secure and make sure our emails do not end up in your spam folder.
- Each email address can have up to 3 sites online or awaiting confirmation at the same time. Expired sites, sites taken offline and removed sites do not count. A site can be up to 25 MB, with up to 500 files and up to 10 MB per file. Do not try to get around these limits, for example by using extra email addresses.
- If you do not confirm within 12 hours, we delete everything.
How long your site stays online
- Your site stays online for 6 months from the moment it goes online.
- We email you 14 days before the end.
- Renewal is not currently available. Putting a new version online does not extend your site's term either: its end date stays the same.
- If a custom domain is linked to your site, it does not expire. If you unlink the domain yourself, the old term simply continues. If we unlink the last domain, a new 6-month term starts. We can also mark a site as “does not expire”.
- If we temporarily take your site offline or remove it and then restore it, the end date of your term stays the same. If that date is then close or has already passed, your site will stay online for at least another 14 days, and we will email you about it.
- At the end of the term, your site goes offline. You will receive an email about this.
- 30 days later, we delete your site and your email address. You cannot restore an expired site yourself. If you want it online again, upload it again; it will get a new address.
- Your site may remain in our backups for up to 12 months after that. See the privacy policy.
What can change: lifespan, limits and price
Paddenstoel is new. We may change site lifespans and limits, for example if costs or usage differ from what we expect, or to prevent abuse. Renewal is not currently available; it may become available for a fee later. Here is what we agree:
- We will not shorten a term that has already started. We can only do that if we shut down Paddenstoel (see Stopping).
- A new lifespan or price only applies to sites you put online after that, or if you later choose to keep your site for longer.
- New size and number limits apply to new uploads. We will not take a site that is already online offline because of them.
- We will email you at least 30 days before a change applies to your site, explaining what is changing and why.
- You will never pay anything unless you choose to. If renewal becomes available for a fee later, you decide whether you want it. If you do nothing, your term simply ends and it costs you nothing.
- Additional terms and prices apply to paid features. You will see them before you pay.
What is not allowed
We do not accept websites that break the law. You are responsible for everything on your site. The following are not allowed in any case:
- phishing, scams or fake shops, or impersonating someone else (a person, company or organisation);
- asking visitors on your site for passwords, PINs or payment details (separate from Paddenstoel's own password protection, which you can turn on yourself);
- malware, cryptominers or code that attacks visitors, other sites or Paddenstoel;
- child sexual abuse, terrorist content, or calls for violence or hatred;
- pornography or other sexually explicit content;
- text, photos, music, trademarks or software belonging to someone else without permission;
- other people's personal data without a good reason, for example to harass someone;
- spam, or pages that only redirect to other sites or mislead search engines;
- illegal gambling, or selling illegal or dangerous goods;
- using Paddenstoel to store or provide downloads of files that are not part of your site;
- overloading Paddenstoel, or trying to bypass its security or limits.
Sometimes something is not prohibited but harms all sites on Paddenstoel, for example because it causes browsers or email providers to block paddenstoel.app. We may take such a site offline too. We will fairly assess whether that is proportionate, also taking freedom of expression into account.
Your site, your responsibility
- Your site is public. Do not put anything on it that needs to stay secret.
- We count visits to your site only as daily totals, without cookies and without recording who visited. You can read how this works in the privacy policy.
- Do you use scripts, fonts or videos from others, or collect visitors' data? Then you are responsible for what happens with them, and you must comply with privacy law (GDPR) and cookie rules yourself.
Your rights to your site
What you create remains yours. You only give us permission to store your files, copy them (including in backups) and display them to everyone who visits your site. We use that permission only to operate Paddenstoel and investigate abuse. That permission is free of charge and ends when your site is deleted; for backups, it continues until they expire. You promise that you are entitled to give us this permission. The Paddenstoel name and logo remain ours.
Report abuse
Have you seen a site that breaks the law or these terms? Email abuse@paddenstoel.app. Include in your report:
- the address (URL) of the site or page;
- what is wrong and why, as precisely as possible;
- your name and email address (not required for child sexual abuse);
- a statement that you believe in good faith that your report is accurate.
We confirm that we have received your report and let you know what we have decided. If you often submit reports that are clearly incorrect, we may stop handling your reports for a while.
How we check sites and take action
- We do not review every site in advance. We review sites after a report, and sometimes on our own initiative.
- A human always makes decisions about content. We only automatically reject disposable email addresses and limit how much someone can upload and email.
- If a site breaks the law or these terms, we may temporarily take it offline or remove it. We may also block the email address: that address can then no longer create sites, and we also remove the other sites belonging to that address.
- We choose a proportionate response. Sometimes we warn you first. In serious cases, such as phishing or malware, we act immediately.
- No later than when we take action, we email you the reasons: what we did, which content is involved, which rule or law we believe you broke, whether it followed a report, and how to appeal. We only delay this if the police or another authority asks us not to say anything yet.
- We usually keep a removed site for another 30 days so we can restore it if we made a mistake. After that, we delete it. In cases of serious abuse, such as phishing or malware, we delete it immediately. If the police or a court needs the data, we keep it for longer or give it to them.
- If we believe someone's life or safety is at risk because of a crime, we report it to the police. We comply with orders from authorities and courts.
Appealing a decision
Do you disagree with our decision, as the owner or the person who reported the site? Reply to our email or email abuse@paddenstoel.app. Please do so preferably within 30 days, because after that a removed site is deleted (earlier in cases of serious abuse). An administrator will review it again, preferably someone other than the person who made the first decision. We will let you know our decision within 14 days.
You can also always go to court, or file a complaint with the Netherlands Authority for Consumers and Markets (ACM), which oversees these rules in the Netherlands.
Keep your own copy
Paddenstoel is not a backup service. Our backups are for restoring the platform, not for returning individual files to you. So always keep your own copy of your site.
No guarantees
Paddenstoel is free and a trial version. We do our best to keep your site running well online, but we do not promise that it will always be available or fast, or that we will never lose anything. Sometimes we need to carry out maintenance or fix something quickly; your site will not work for a while then.
Liability
- Paddenstoel is free. We are therefore not liable for damage caused by using Paddenstoel, for example because your site was unavailable or your files were lost. So always keep your own copy.
- This does not apply if we caused the damage intentionally or through gross negligence. It also does not apply to damage caused by a mistake we made with your personal data, or where the law otherwise does not allow it.
- For paid features, we agree on liability separately.
- Does your site break the law or these terms, and does someone make a claim against us because of it? Then we may recover the resulting damage and reasonable costs from you, if it is your fault and to the extent permitted by law. If you are under 16, your parents or guardians may be liable for this.
Stopping
- You can stop at any time. Remove your site yourself at My mushrooms or at Remove your site: the site then goes offline immediately and no longer counts towards your three sites. After 7 days, we delete the site; until then, you can restore it in My mushrooms if there is room and the 6 months are not over. If you only temporarily take the site offline there, you keep its slot and the term continues. Want us to delete everything immediately? Email privacy@paddenstoel.app from your site's email address. Or simply let the term expire.
- We may shut down Paddenstoel, for example when the trial ends. If we do, we'll email you at least 30 days in advance so you can move your site elsewhere. We'll only act sooner if there's really no other option, for example because of a serious security issue or if required by law or a court.
- While Paddenstoel is a trial version, we may also need to rebuild everything, which may mean sites disappear. We'll email you as early as we can.
If a company is set up
We'll set up a company to continue running Paddenstoel. That company will take our place under the same terms. This will not reduce your rights. We'll email you when this happens. If you don't want to continue, you can have your site deleted.
If these terms change
We may change these terms. We'll email you about important changes at least 30 days before they apply to you. If a change puts you at a disadvantage, it will only apply from your next term; until then, your existing terms will remain in place. This does not apply if the change is required by law or to prevent abuse. We'll only post small improvements, such as clearer wording, on this page.
Governing law and courts
These terms are governed by Dutch law. If you live in another EU country as a consumer, you retain the protection of your own country's mandatory rules. If we can't resolve a dispute together, it will be decided by the court with jurisdiction under the law.
